Terms of Service

1. Acceptance of Terms

By using Falcon Messenger, you agree to these Terms of Service.

2. License & Use

Falcon Messenger is provided under a paid license. Users may freely connect to servers hosted by other users once they have the software. The developer grants no access to user accounts or messages after installation.

3. Purchases

An email and password are required to purchase Falcon Messenger and receive updates. All purchases are final unless otherwise specified.

4. User Responsibility

Users are responsible for the operation and security of their own servers. Users must comply with applicable laws, including age restrictions.

5. No Warranty

Falcon Messenger is provided “as is.” The developer is not responsible for loss, corruption, or misuse of data on user-hosted servers.

6. Limitation of Liability

The developer is not liable for any damages, including but not limited to server outages, loss of messages, or misuse of the software by other users.

7. Dispute Resolution

Before initiating any legal action regarding Falcon Messenger, you agree to first attempt to resolve the matter informally by contacting the developer. A minimum of 30 days of good-faith communication must occur prior to filing any lawsuit or formal complaint.

8. Updates and Changes

The developer may provide updates at their discretion. Users are encouraged, but not required, to apply updates. No liability arises from failure to update.

9. Refund / Subscription Policy

If you sell updates or licenses: All sales are final. Refunds are only issued at the developer’s discretion. Subscriptions renew according to the terms set at purchase.

10. Governing Law / Jurisdiction

Helps determine which country’s laws apply in disputes: These Terms are governed by the laws of Gauteng, South Africa. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in Gauteng, South Africa.

11. Changes to Terms

The developer reserves the right to update or modify these Terms of Service at any time. Changes will take effect immediately upon posting to the official Falcon Messenger website or distribution platform. Users are responsible for reviewing the Terms periodically. Continued use of Falcon Messenger after changes constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between the developer and the user regarding Falcon Messenger and supersede all prior agreements, understandings, or communications, whether written or oral.

14. Indemnification

You agree to defend, indemnify, and hold harmless the developer from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or related to your use of Falcon Messenger, your operation of servers, or your interaction with other users. The developer has no responsibility or control over how the software is used, and all risks are assumed by the user.

15. Prohibited Conduct

Users may not use Falcon Messenger for illegal activities, harassment, unauthorized access to systems, or any action that violates applicable law. Falcon is not responsible for user behavior on self-hosted servers.

16. Availability

No guarantee is made regarding continuous availability, uptime, or error-free operation of Falcon Messenger. The developer is not liable for interruption of service on user-hosted servers.

17. Data Responsibility

All data transmitted or stored using Falcon Messenger is controlled entirely by the user or server operator. Falcon does not retain or access message content, metadata, or backups. Users are solely responsible for securing and managing their own data.

18. Export Compliance

Users are responsible for complying with all applicable export laws and regulations regarding the use of encryption technologies available in Falcon Messenger. Falcon makes no representation regarding user compliance.

19. Modifications

Falcon permits users to modify or create add-ons, themes, or integrations (“Mods”) for personal or non-commercial use, provided such modifications comply with these Terms. You may share Mods freely and non-commercially, as long as they: Clearly identify Falcon as the original platform. Do not misrepresent themselves as official Falcon products. Do not contain malicious, harmful, or infringing content. Are distributed only as standalone Mod files within the designated Falcon mod folder — not as complete or modified versions of the Falcon server, software, or core files. Commercial distribution, resale, or monetization of Falcon or any derivative work based on it — including paid Mods, custom builds, or bundled versions — is strictly prohibited without prior written authorization from Falcon.
